Our client was charged with possession of a firearm on a school campus. We knew the search was illegal and we were prepared to contest it and proceed with trial. On the day we were set for trial, we showed the state the problems with the case which led to a dismissal.

I believed there was a problem with the legality of the stop and probable cause to search his vehicle. I set the case for a motion to suppress and after hearing the evidence the judge ruled in my client’s favor and held the evidence was inadmissible. Instead of facing a potential sentence of 10 years to life, my client’s charges were dismissed.

The initial offer included a strong chance of prison time. I knew that there was something wrong in how the case was handled by SAPD. I also knew that there were issues with the medical records provided to the state by the hospital. Last week we rejected the offer of 5 years of probation to the charged offense. We appeared in court today for a discovery hearing. The state agreed that I was correct about the case. My client was able to plead to a class B misdemeanor and 1 year of deferred adjudication. I would like to commend Joe Gonzales, and his staff at the DA’s office, for their commitment to true justice.
